Terms of Service

By accessing or using the Kitsho platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

These Terms apply to all visitors, registered users, and any party who accesses or uses the Service. By creating an account, you represent that you are at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the entity you represent.

To access most features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must notify us immediately of any unauthorized use of your account. Kitsho is not liable for losses arising from unauthorized access that results from your failure to safeguard your credentials.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period.

Kitsho offers free and paid subscription plans. Paid plans are billed monthly or annually, as selected at the time of purchase. Prices are displayed in USD and may vary by region.

All fees are non-refundable except where required by applicable law or as explicitly stated in our cancellation policy. You may cancel your subscription at any time; access continues until the end of the current billing period.

We may change pricing with at least 30 days' written notice. Continued use after a price change constitutes acceptance of the new pricing.

If payment fails, we may suspend your access after a 7-day grace period. Persistent non-payment may result in account termination and data deletion.

You agree to use the Service only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations.

You may not: (a) reverse-engineer, decompile, or disassemble any part of the Service; (b) use the Service to send spam, phishing content, or unsolicited commercial messages; (c) attempt to gain unauthorized access to other users' accounts or Kitsho's systems; (d) upload content that is defamatory, obscene, or violates intellectual property rights; (e) use the Service for any purpose that competes with Kitsho's business.

Violation of this section may result in immediate suspension or termination of your account without prior notice.

All content, software, trademarks, and intellectual property on the Kitsho platform are owned by Kitsho Technologies Inc. or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

Content you upload to the platform (menus, images, business data) remains your property. By uploading, you grant Kitsho a non-exclusive license to process, store, and display this content solely for the purpose of providing the Service.

Feedback, suggestions, or ideas you provide may be used by Kitsho without obligation or compensation.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the practices described therein.

You are responsible for ensuring that any personal data you process through the platform complies with applicable data protection laws in your jurisdiction.

We aim for 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time. For material changes, we will provide reasonable advance notice.

To the maximum extent permitted by law, Kitsho and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total aggregate liability for any claim arising from or related to the Service shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Kitsho and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

Either party may terminate these Terms at any time. You may delete your account through the platform settings. Kitsho may terminate or suspend your access immediately if you breach these Terms.

Upon termination, your right to use the Service ceases. Data retention after termination is governed by our Privacy Policy.

These Terms are governed by and construed in accordance with the laws of the Arab Republic of Egypt, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Cairo, Egypt.
